October 1 Bombing: Lack of Psychiatric Report Stalls Okah’s Trial

The non-availability of a psychiatric report to ascertain the mental state of Mr. Charles Okah, who was charged for masterminding the October 1, 2010, bombing, yesterday stalled his trial before Justice Gabriel Kolawole of a Federal High Court.
 
Okah and Obi Nwabueze were charged for masterminding the October 1, 2010, bombing at the Eagle Square, Abuja, where several people died as a result of the explosion.
 
When the case came up yesterday, the News Agency of Nigeria (NAN) reported that the parties were informed that the reports of fresh medicals, which the judge ordered to be conducted on Okah at the last sitting were not ready.
 
The initial report read in part: Okah suffers from “psychotic depression, fatigues disorder and auditory/visual hallucinations”.
 
The said report dated January 9, was signed by a Senior Consultant Psychiatrist with the National Hospital, Abuja, O. T. Ephraim Oluwanuga.
 
The lead prosecution counsel, Alex Iziyon (SAN), had earlier told the court that based on the initial report, Okah was fit to stand trial. He urged the court to go on with the trial.
 
Justice Kolawole had observed that the report contained some medical terms, which even he could hardly comprehend. He then ordered fresh medical examination to be conducted at the National Hospital, Abuja, by two or three psychiatrists, who must jointly sign the report.
 
He further directed that the report should be written in common English language that could easily be understood by a layman and submitted to the court three days before February 5.
The judge held that it was the position of the law that an accused person should be medically fit to stand trial.
 
Justice Kolawole said the case against the accused person was weighty and attracts severe punishment.
 
The Judge said although the court’s rules require that criminal cases be heard promptly, he would rather be careful in this case.
 
 
Justice Kolawole reasoned that this was to avoid wasting judicial time and resources in conducting a trial that could be nullified by the appellate court on health ground.
He then adjourned the case to April 2 for continuation of trial upon studying the fresh medical report on Okah’s health status.
 
The judge had in a ruling in January ordered that a fresh medical examination be conducted on Okah within 15 days to confirm his mental state, after rejecting an initial one.
 
The ruling followed an observation raised by Okah’s counsel, John Ainetor, who had argued that there were some inconsistencies contained in the report.
 
Four people, believed to be members of the Movement for the Emancipation of the Niger Delta (MEND), were in December 2011 arraigned over the bombings.
The leader of the group, Mr. Henry Okah, was later convicted and sentenced to jail in South Africa.
 
One of them, Tiemkemfa Osvwo, aka General Gbokos, died later; while another, Edmund Ebiware, who was tried separately, was sentenced to life imprisonment.

$1:69m Fraud: Ajudua Re-arraigned

A suspected serial fraudster, Fred Ajudua, accused of duping two Dutchmen, Remy Cina and Pierre Vijgen, of $1.69 million between July 1999 and September 2000, was Wednesday re-arraigned for the second time before an Ikeja High Court.
 
 
Ajudua and his co-defendant, Charles Orie, are facing trial for defrauding Remy Cina and Pierre Vijgen, two European businessmen, of $1.69 million (N287 million).
 
 
The Economic and Financial Crimes Commission (EFCC) accused Ajudua, Orie, Rasheed Adekunle, Abisola Fawehinmi, and Stephen Joiner (the last three are still at large) of committing the crime between 1999 and 2000.
 
  Ajudua, who is also known as Isa Audu, and the others allegedly obtained the money from the businessmen as sundry payment to various government officials for payment of an $18 million contract No. FMA/EED/3040/S92, according to the EFCC.
When the four-count charge of obtaining money by false pretence was read to the defendants, both pleaded not guilty.
 
Ajudua, his alleged accomplice, Orie were first arraigned by EFCC before Justice Olubunmi Oyewole in 2003.
They were, however, re-arraigned before Justice Kudirat Jose on a four-count charge of conspiracy, obtaining money by false pretence and inducing payment by false pretence.
 
The transfer of the case to Justice Jose was necessitated by the withdrawal of the former trial judge, Justice Joseph Oyewole, from the case, due to the redeployment of judges.
 
At Wednesday’s proceedings, a pale-looking Ajudua and his co-defendants pleaded not guilty to the charges and his counsel, Olalekan Ojo, asked the court to allow his client to perfect the extant bail granted him in September 2013 on health grounds by Justice Ganiyu Safari, a vacation judge.
 
“I wish to inform my lord that from the charge, this is the tenth year that the matter commenced. In the chequered history of this case the first defendant developed health problems. The first defendant has a barrage of health problems," he said.
 
“I wish to bring to your lordship's notice that on the 16th September, 2013 that Justice G.A. Safari granted him bail on health grounds. Your lordship should exercise your discretionary power to allow the first defendant to perfect the extant bail granted by Justice Safari,” Ojo said.
 
Counsel to Orie, Ndubuisi Esekea, also prayed the court to allow his client to continue to enjoy the bail earlier granted him.
The prosecution counsel, Olumuyiwa Balogun, who did not object to the second defendant's application, however opposed the oral plea made by Ojo on behalf of Ajudua.
 
Balogun said while he would concede that the court has the discretionary power to grant Ajudua bail, he ought to bring a fresh application before it.
 
He argued that Justice Jose was not bound by the decision of the judge that previously granted the first defendant bail.
 
Justice Jose ruled that both defendants should file fresh applications for bail and fixed the hearing of the bail application for February 20. The judge also fixed the trial for April 28 and 29.

Boko Haram: NAF’s Bombardment Drives Insurgents to Chad, Niger, Cameroun

The Nigeria Air Force (NAF) Wednesday said it had intensified the bombardment of hideouts and camps of the outlawed Boko Haram sect in Borno State, which had led many of the sect’s members fleeing to neighbouring Chad, Niger Republic and Cameroun.
 
The Air Force, in a statement by its 79 Composite Group with headquarters in Maiduguri, said in the last few days, it had regrouped and recovered from the December 2, 2013 attack on its base to effectively deal with the insurgents.
 
The statement signed by the group’s Public Relations Officer (PRO) of the 79 Composite Group, Squadron Leader Chris Erondu, stated that it had “reintensified its efforts in the fight against Boko Haram terrorists in the North-east, as it’s air operations has resulted to heavy casualty on the side of the insurgents residing in their camps  around the Sambisa forest.”
 
Erondu said: “Unperturbed by the incessant threats by the Boko Haram terrorists in the North-east, especially the insurgents recent attacks and sacking of many communities in Borno State, the NAF is increasingly committed in the current fight against terrorism not only in the state, but the country in general.”
 
Accordingly, he added that, in line with NAF task to restore normalcy in the city of Maiduguri, the 79 Composite Group had in the couple of weeks been providing air supports to other sister security operatives of the ‘Operation  Zaman Lafiya’ in Maiduguri metropolis and its environs.
 
Consequently, the NAF spokesman pointed out that based on intelligence reports on the excesses of the insurgents, the group in conjunction with the 75 Strike Group  NAF, Yola, Adamawa State deployed air platforms, which carried out air surveillance, interdiction and raid operations on identified Boko Haram hideouts located at Bullabulin, Yujiwa, Alagarno, Damboa axis of the state.
 
He noted that the results of these air operations have been remarkable as the insurgents, who have resorted to retreating to neighbouring countries, such as Cameroun, Chad and Niger Republic have suffered heavy casualties, after destroying their camps in the Sambisa forest. 
 
He stressed that consequent upon these efforts, law and order have returned to Maiduguri, as men of the Joint military Task Force (JTF) ‘Operation Zaman Lafiya’ and other security agencies have maintained constant security watch of Maiduguri metropolis and its environs with residents going about their normal business activities.

US Envoy Hails Nigeria’s Press Freedom

The United States Ambassador to Nigeria, Mr. James Enwistle, Wednesday acknowledged that the media in Nigeria was free with less regulations and government control.
 
Enwistle, who stated this Tuesday evening in Abuja, when he paid a courtesy visit to the Minister of Information, Mr. Labaran Maku, in his office, “I have served in countries where the media is very restricted and there is tight government control of the media and so on.”
A statement signed by Maku’s Press Secretary, Joseph Mutah, quoted the Ambassador as saying that his tour of duty to various countries had exposed him to media restrictions but discovered that the contrary in Nigeria.
 
According to him, the Nigerian media is open for robust debates and news reports.
“So, it’s been a pleasure to come to Nigeria and as I was discussing with the Minister, to find that the media scene it seems to me is completely wide open.  I can say that having recently spent a lot of time on television being asked some tough questions by journalists and there’s not a complaint, that’s a good thing,” he said.
 
He added that it was gratifying for governments to remain open and promote sharing of information between government and citizens to enhance public confidence and transparency in government activities.
 
“I think it’s a healthy thing in my country and your country as government begins to get over itself and loosen up and realise that openness and transparency and sharing information, remembering that in government, we work for the people and if the people want to know about government functions, if they want to know where their taxes go and how they were used, they have the right to request that information. 
 
“But I know in my own background, it’s difficult for governments to go down that road, I am very impressed by the progress you have made in that direction so I am glad to congratulate you on that,” he added.
 
Enwistle described Nigerian journalists as highly knowledgeable and hard-working.
In his remarks, Maku emphasised President Goodluck Jonathan’s commitment to free media and access to information, which according to him, informed the signing into law the Freedom of Information (FoI) Act to promote transparency and accountability.
 
“We believe as a country that given our experiences, we needed to deliberately support the media to develop; to be free and that is exactly what we did in 2011 when the President signed the Freedom of Information Act into law.  We have also more than any country in the continent, highest number of private newspapers, television stations and radio stations and these are very active,” he said.

FG Begins Implementation of UNEP Report on Ogoniland, Says NOSDRA

The federal government has started implementing the United Nations Environment Programme (UNEP) report on Ogoniland by addressing some emergency measures to provide alternative facilities for the affected communities, an official has said.
 
The Director-General of National Oil Spill Detection and Response Agency (NOSDRA), Mr. Peter Idabor, disclosed this in an interview with the News Agency Nigeria (NAN)  in Abuja Wednesday.
 
Idabor was quoted as saying that the federal government had initiated a Hydrocarbon Pollution Remediation Project (HPRP) to provide alternative facilities for the Ogoni communities.
 
“What we are dealing with now are emergency measures that UNEP has requested to start with – providing alternative sources of drinking water, putting signs to ward off people from having their baths in dangerous areas.
 
“Trying to set up a hospital registry to determine if there is any correlation between the number of deaths and oil activities in Ogoniland. I think those things are being done but the Federal Government set up a body called HPRP of which the Federal Ministry of Environment is part of the governing body, including NOSDRA. Our job is to regulate and to effectively make sure that Ogoni is cleaned up,” he said.
 
Idabor said NOSDRA, as a member of the committee (HPRP), was charged with the mandate to regulate the process of remediation and restoration of the land.
 
The director-general said the HPRP had started the first step in implementing the report by carrying out emergency measures to make the communities safe for people to live in.
 
The UNEP report on Ogoniland was released on August 4, 2011 confirming claims by local communities and civil society groups that there exists an ecological disaster in the area.
The report also showed hydrocarbon pollution in surface water throughout the creeks of Ogoniland and up to eight centimetres in groundwater that feed drinking wells.
 
Idabor said one of the recommendations in the UNEP report is for a committee to be constituted by the federal government to oversee and handle the process of remediation and restoration.
 
One of the main contents of the report, which is the establishment of a restoration fund for Ogoni, with an initial sum of $1 billion by Shell and the federal government, was yet t o be done.
 
The NOSDRA official, however, called on the people involved in illegal bunkering of petroleum to desist from the act to avoid polluting the environment, saying most oil companies that caused pollution now hide under the cover of illegal bunkering.
 
“Most of the oil companies now have a good place to hide under. Anything that happens, they say the oil that is being spilled into the environment more is coming from sabotage to oil theft; they use that as a cover.
 
“If our people will learn that this issue of doing bunkering and refining crude and oil theft, if they can stop it, it becomes clear who is really polluting the environment.
 
“It is becoming very easy for oil companies to deny that they will pay compensation because anything that happens now, they come under that canopy (bunkering) and say they cannot be held responsible. They say that oil spillage in Nigeria is caused by human factor not necessarily by equipment failure, whereas some of them have their pipelines that are already aged,” he said.
 
The NOSDRA was established by Act No. 15 of 2006, to address environmental degradation and devastation of the coastal ecosystem, especially in the oil-producing areas of the Niger Delta region.

MDGs: FG Deploys 1,480 Health Workers to I48 Villages

In a bid to fast track the achievement of the Millennium Development Goals (MDGs), especially in health related goals, the federal government yesterday inaugurated the Village Health Workers Scheme (VHWS).
 
Speaking during the inauguration at the state house in Abuja, the First Lady Patience Jonathan disclosed that the scheme, which has created jobs for young school leavers would see a total of 1480 village workers deployed to communities in about 148 local government areas across the country to support the health officers in the various communities.
She further said the VHW will encourage people living in the rural communities make use of the health facilities provided by the government.
 
Dame patience further added that there has been lot of progress in the health goals which she said shows the transformation agenda of the president is giving priority to the health of its citizens.
 
“The launch of the scheme is part of the president’s desire to give health to its citizens and also create jobs,” she said.
 
While urging politicians not to play politics with the health of the citizens that voted them in, she asked both states and local government to do their part as achieving the MDGs was a collective task.
 
Explaining more on the scheme, the Senior Special Assistant to the president on MDGs, Dr. Precious Gbeneol, said the village health workers scheme was established to serve as a link between community and health services, to provide increased utilisation of health care facilities provided by OSSAP-MDGs and other stakeholders, amongst others.
 
“The scheme is expected to make the required impact of contributing to improved community health outcomes by: increasing the uptake and utilisation of health care facilities provided by OSSAP-MDGs and other stakeholders; increasing mobilisation drives that stimulate the demand side of health services delivery for enhanced ownership, responsiveness, sustainability and accountability; contributing to the functionality and sustainability of health care facilities through close collaboration with other stakeholder groups.
 
The Village Health Workers will assist health facilities to initiate and manage health promotion and awareness creation activities. They are also expected to be vanguards of advocacy campaigns, mobilisation of individuals, households and communities, provide data management and baseline inventory of households on health related issues amongst other services.
 
“The Village Health Workers Scheme will also generate employment for many Nigerians. At the moment, more than One thousand, four hundred (1,400) Village Health Workers have been trained across the six geo-political zones of the federation,” Gbeneol stated.
 
The scheme, which runs across 148 local government areas, was expected to run for two years.

Borno Gives N6.5m to Victims of Police Brutality

Borno State Governor, Alhaji Kashim Shettima, Wednedsday directed that N6.5 million should be paid to the victims of police brutality at the University of Maiduguri Teaching Hospital (UMTH).
 
Some policemen had besieged the UMTH last year, after their colleagues were killed by suspected Boko Haram members in Bama, destroying properties and beating up hospital staff for allegedly not giving the victims the required attention.
 
The governor, who received the report of the committee set up to look into the incident, directed the state Ministry of Finance to immediately release the sum of N6.5 million to assist the victims of the brutality.
 
Shettima, who commended the management and staff of the UMTH for the maturity they show during the incident, praised the committee for doing a thorough job and assured them that the recommendation of the committee would be implemented to the letter.
The chairman of the committee, Alhaji Shehu Liberty, thanked the governor for his magnificent strides in the health sector especially in polio eradication, noting that UMTH management also constituted a committee, following the incident on one of the medical staff of the hospital.
 
Liberty said the committee hailed the governor for his timely intervention on the matter that prevented the staff of the hospital from embarking on strike, after the committee discovered in its findings that many staff sustained various degrees of injuries.
 
He said the committee recommended that Dr. Abba Kabir, who sustained fraction in his leg during the beating, should be given N3 million, Professor Ngada, N500,000; Chairman of the Medical Advisory Committee (CMAC) of the hospital, Dr Bashir, N1 million and the 29 other staff of the UMTH who lost their properties during the incident should be given N1 million to share.
 
Liberty assured the governor that the UMTH would continue to partner with the state to provide healthcare delivery services to the people despite what happened.

Wamakko, Christian Group Want Killers of Islamic Cleric Arrested

Sokoto State Governor, Alhaji Aliyu Wamakko, Wednesday called on the federal government to unravel those behind the killing of the Zaria-based Islamic cleric, Sheikh Adam Albani.
 
Also, Northern State Christian Elders Forum (NOSCEF) has condemned the recent murder of Sheikh Muhamman Auwal Albani Zaria, one of his wives and son, describing him as “Champion of faith.”
 
Wamakko’s who made the call in a statement signed by his Special Adviser on Media Affairs, Malam Sani Umar, and made available to THISDAY in Sokoto, described the dastardly murder of the cleric as an illustration of lack of security in Nigeria.
 
The statement condemned in strong terms the heinous act and therefore called on the federal government and security agencies to uncover those behind the killing of the cleric.
 
“The murder of the Islamic cleric is an indication that there is no security in Nigeria, thus, the federal government should do whatever it takes to unravel those behind the dastardly act. The investigation of the murder of the cleric should not be swept under the carpet like other unresolved killings in the country,” the statement read.
 
According to the statement, the gruesome killing of the Islamic scholar had shown that Nigerians are no longer safe in their country.
 
According to the statement, a delegation from the state had already visited Zaria to condole with the family of the slain cleric, adding that a prayer has be offer to God to grant the deceased eternal rest and the family the fortitude to bear the irreparable loss.
 
Meanwhile, the Christian forum in a statement signed by its Chairman, Olaiya Phillips and National Secretary, Emmanuel D. Subilim, and made available to THISDAY yesterday said the late cleric was a well-respected leader of his community and Islamic scholar.
According to them, “He has shown great courage in opposing the Boko Haram sect. Once again, the enemies of religious belief have sought to silence the voice of a champion of faith.
 
“On behalf of NOSCEF and people of faith across northern Nigeria we express our deepest condolences to the family of Sheikh Zaria.”
 
NOSCEF noted that all Nigerians have the right to speak out and worship freely, without the threat of violence or intimidation, adding that action should be taken to protect these freedoms for all Nigerians, including Christians and Muslims.
“How many more people of faith must be murdered before the necessary action is taken to safeguard the simple act of worship?
 
“Today, the people of northern Nigeria of all religions together mourn the passing of a fellow patriot. May his soul, that of his wife and son truly rest in peace,” the statement said.

Maina: Northern Youths Plan Protest in Abuja, Kaduna

The Arewa Youth Alliance (AYA) has disclosed its plan to embark on a peaceful demonstration next Wednesday in Abuja and Kaduna to protest against the uncertainty trailing the reinstatement of former Chairman of the Pension Reform Task Team (PRTT), Abdulrasheed Maina.
 
National Coordinator of the group, Mallam Isah Amin, in a chat with journalists yesterday in Abuja, explained that the protest was to draw attention over the failure of the federal government to act on the judgement of the Federal High Court in Abuja setting aside the sack of Maina from the civil service.
 
Amin said the protest was also to decry the incessant harrasment by the police against the former PRTT boss, adding that Maina has been under siege by the police despite having nothing established against him.
 
“It is unacceptable and unfortunate that a man who recovered over N150billion of pension funds, and injected over N70billion into the 2012 budget should become a fugitive in his country.
 
“We were witnesses to the drama orchestrated by the Senate Committee on Pension and Establishment, headed by Senator Aloysuis Etuk on the PRTT wrongdoings. Is it not curious that till date, Etuk's committee has failed to make the report of his committee public, and this to us as northern youths, is unacceptable," the group said.
 
Amin described Maina's travail as the height of impunity and injustice,' thereby appealing to President Goodluck Jonathan to as of urgency, take decisive action on the matter.
 
He noted that the prosecution of alleged pension thieves would not have been possible without Maina, adding that despite the huge sums recovered by the Maina's pension team, the government has failed to release any fund to those responsible for the recovery and however, challenged the Ministry of Finance to counter the allegation.

Uzodimma who represents Imo West in the senate and member of the PDP Board of Trustees (BOT) in a statement in Abuja on Tuesday, also predicted that his party would win minimum of 28 out of the 36 states of the federation.
 
He expressed confidence that the PDP would shock APC in the polls because the opposition party had been busy looking for media attention by playing to the gallery and also trying to create the impression of nonexistent popularity, saying in the process, the party has completely forgotten to address the real issues of governance.
 
“It is either the APC is issuing directives to cause disaffection in the National Assembly or they are celebrating the defection of one aggrieved PDP member or the other or they are making one provocative statement here and there just to catch media attention at the expense of real issues of governance,” the senator said.
The lawmaker said while the APC was busy chasing shadows, the PDP had gone back to the drawing board, networking with the grassroots and putting its house in order for 2015.
 
“Right now, as the clock ticks, our national chairman and his team are working round the clock to ensure that the PDP is stronger, more united and at home with the grassroots while opposition is busy gallivanting and sensationalising every trivial issue just to make media headlines,” he said.
 
He opined that the APC would wake up too late to discover that while they were busy savouring media euphoria over non-issues, majority of Nigerians have already made up their minds to vote for PDP because the PDP has remained focused, dependable and trust worthy.
 
Uzodimma recalled that the 2014 budget which is targeted at creating jobs for Nigerians is a clear indication that President Goodluck Jonathan is tenaciously focused on the welfare of Nigerians.
 
 
According to him, the 2014 budget has been well packaged by the federal government to create jobs through the completion of the privatisation of the power sector, the completion of the East-West road, the dualisation of Abuja-Abaji-Lokoja road, the dualisation of Kano-Maiduguri road and the complete rehabilitation of Lagos-Ibadan expressway, Enugu-Portharcourt expressway, Onitsha-Enugu road as well as the construction of the all-important second River Niger bridge.
 
The budget, Uzodimma said, also made provisions for well thought out agricultural programmes that would boast job creation, such as subsidy to  five million farmers in the country and Youth  Employment in Agricultural Programme (YEAP) which would also create over a million jobs this years.
 
He noted that a clear pointer that APC is no alternative to PDP is their inability to rise to the occasion of the 2014 budget proposals as an opposition party.
 
“A serious minded opposition party should have, by now, come out with objective criticism to the 2014 budget proposals with clear suggestions on how they can do it better for Nigerians to asses. But not so with APC; instead they are busy attending to issues that do not tell Nigerians how they intend to govern better than the PDP,” he stated.
 
 
The PDP chieftain noted that APC had the highest concentration of what he described as “most recycled politicians in Nigeria,” wondering what new idea or vision these politicians can offer that they could not offer in their former parties or positions.
