Sally Mbanefo,DG NTDC Fights In Brazil..Accused Of Fraud

The Director General of the Nigeria Tourism Development Commission (NTDC) Mrs. Sally Uwechue-Mbanefo may be doing everything possible to cover up an alleged fraud in her participation in the ongoing Brazil 2014 World Cup after a failed attempt to chew up a piece of incriminating document in a Brazilian hotel June 18. She has asked for a meeting with President Goodluck Jonathan to explain her role in the alleged fraud that is threatening her credibility,.
Mbanefo was alleged to have diverted an undisclosed amount of money meant for the sponsorship of a proposed Nigerian Fan’s village in Brazil, after which she asked for the Memorandum of Understanding (MoU) between her and Za Entertainment, the contractor for the project; tore it and began to chew the paper. Her attempt to chew and swallow the MoU led to a physical altercation between her and President of Za Entertainment, Mr. Azania Omo-Agege who held her tightly forcing the papers out of her mouth.
 
He said: “Two weeks to the tournament, we had an MoU that includes how much we were going to be paid and I went around seeking for funds for the project.
 
“From information available to me, about four banks may have paid money to her and we have not seen anything and the failure of the fan’s village project should be blamed on the NTDC.
 
“We did everything possible to help them but unfortunately it has ended the way it did
“The brochure provided that all payments be made to either our own account or Omo-Agege’s account but that was not done. I also understand that some banks gave them money and the people at the NTDC should be able to account for that.”
 
When The Nigerian Times called to speak with the NTDC boss, her aide promised that she would call back as she was in a meeting, but instead her lawyer who identified himself as Barrister Mark Ibrahim called to say he had been asked to speak on her behalf.
 
He said: “The NTDC entered into an agreement with one Mr. Azania Omo-Agege the President of Za entertainment and the agreement provides that Omo-Agege who is the initiator shall source the funds and drive same and shall also construct the village and maintain same for the entire duration of the world cup.
“Her contention is that these two things were not done by them; there was no village built as contracted, instead of that, Omo-agege was now asking for more money after he had already been given $10,000 before leaving Nigeria.
 
“He was not ready to fulfill his own part of the agreement but the DG had to use one of the rooms in the hotel in which she stayed as a mini fan’s village in order not to disappoint Nigerians.
 
“According to her the man was supposed to raise funds for all that but refused to do so.”

The lawyer denied any altercation between the DG and the contractor claiming her kind of person would not do such. He however accused Omo-Agege of threatening his client in Brazil.'

Orphan Davion Only Who Made 'Love Me Forever' Plea Removed From New Home (ABC News)

The orphaned teenager who made an emotional plea last year for a family to adopt him and "love me forever" – and triggered thousands of offers from around the world – has had a devastating setback after he was removed from the home of his potential adoptive family.

Davion Only’s dreams of adoption was disrupted after the 16-year-old had an altercation with a member of his prospective family, according to the Eckerd adoptive agency overseeing Only's adoption.

Only had moved from Florida to Ohio to be with the prospective family this spring for a 90 day trial period. The move was the first step of the adoptive process. According to the Tampa Bay Times, Only was with the family for weeks before being removed. The teen even wrote “I got baptized” on his Facebook page.

However, Only was removed after he had a physical altercation with a child and father, who is a minister, from his potential adoptive family. According to reports from the Tampa Bay Times that were confirmed by the Eckerd agency, Only’s case manager flew to Ohio and took the teenager out of the home and back to Florida on May 30.

The Eckerd agency did not disclose any further information about where Only was or how he was faring.

However, the agency said they still planned to find a “forever home” for Only.

“Davion is a maturing young man whose perspective on life continues to change as it does with most teenagers,” read the statement. “After Davion spent time with a prospective adoptive family this spring, it was determined that the family was not the right fit for him, with that we are asking for privacy during this stage of his life.”

Only won over thousands of supporters after giving an impassioned plea at a Florida church last October asking for a family to adopt him.

"I'll take anyone," Only said. "Old or young, dad or mom, black, white, purple. I don't care. And I would be really appreciative. The best I could be."

In making his plea, Only said he was looking for someone “To love me forever, I just want people to love me for who I am.”

More than 10,000 people responded to Only's plea and the Eckerd agency was overwhelmed with request from people around the world offering to take in the teenager.

Only made the plea for family after searching for his own family and finding out that his birth mother had died weeks before he looked for her. He said he cried after finding out but decided he would not let his mother’s past, which included drug and theft arrests, to define him.

"I just want people to know that it's hard to be a foster kid,” said Only. “People sometimes don't know how hard it is and how much we try to do good.”

When asked what it would mean to finally have a family, Only said, "It will make me have more courage and it will make me look brighter and feel better in general."

NIGERIA: Adamawa Court Dismisses Assembly’s Application Challenging Its Jurisdiction

An Adamawa State High Court has dismissed an application filed by the state House of Assembly to challenge its jurisdiction to entertain the case filed by Governor Murtala Nyako.
Nyako  had earlier obtained an injunction to stop the assembly from going ahead with the impeachment process against him and his deputy.

In his ruling, the acting Chief Judge of the state, Justice Ambrose Mammadi, said the  application on whether his court had the jurisdiction to entertain the suit brought  before him by Nyako was misplaced.

The judge affirmed that his court had jurisdiction to entertain the suit and therefore dismissed the assembly’s application and adjourned further proceedings to July 9. The state High Court had earlier restrained the lawmakers from taking any decision pending the determination of the suit filed by the governor.

After the ruling, counsel to the governor, Ayo Akam, expressed happiness with the ruling, saying: “I am comfortable; my joy is that the court did not say it has no jurisdiction to entertain the case. The matter is still pending before the court, I am okay  with it.
“The action taken by the House of Assembly as at yesterday, I have made it clear, is a violation of the court order.”

It was not clear, however, whether the state acting  chief judge had received any correspondence from the lawmakers to constitute a seven-man panel or not as the Chief Registrar of the court, Alhaji Abubakar Babayola, denied any communication.
“As I am talking to you now, we are yet to receive their correspondence, and if there is any, we would communicate to you,’’ he said.

But when contacted on phone, the Chief Press Secretary to the Speaker of the state assembly, Mr. Solomon Kumangar, said: “The clerk has  since communicated the matter  and it was received at the chamber of the acting Chief Judge before closing hours.”

NIGERIA: House Wades into Doctors’ Strike

The House of Representatives Committee on Health has been  mandated to wade into the industrial crisis pitting the Nigerian Medical Association (NMA) against the Federal Ministry of Health.

The committee, which has a week to accomplish its task and report back to the House, is expected to find amicable ways of resolving the impasse.

The House, acting on a motion on ‘urgent need to resolve the crisis in the health sector’ moved by the Minority Whip, Hon. Samson Osagie (APC, Edo), urged the NMA and its members to call off the strike  they embarked upon on Tuesday.

The lawmakers also appealed to the federal government “to do everything possible as a matter of utmost urgency to have the crisis resolved in the interest of the citizens of this country.

“From the NMA perspective, a number of issues, including the appointment of surgeon-general for the federation, payment of hazard allowances to doctors, retirement age of doctors, expansion of the NHIS (National Health Insurance Scheme) to cover a wider spectrum of the society among others are also some of the issues that the National Assembly (has) passed resolutions on,” he noted.

He expressed worry that the citizens stand a very high risk during emergencies, if medical services are not made available, given the very critical state of insecurity in Nigeria.

Edo Cancels Teachers’ Competency Test, Recalls 936 Sacked Teachers

The Edo State Government has reversed the planned competency test for teachers in the state even as it recalled the 936 teachers whose names were deleted from the payroll for certificate discrepancies and age falsification.

Also, the government announced the immediate extension of the relativity to teachers in the state public schools.

Making the announcements yesterday in Benin City, Governor Adams Oshiomhole at a meeting with the Nigeria Union of Teachers (NUT) and the Nigeria Labour Congress (NLC) said: “On assumption of office, it was very clear to me and my colleagues that our future is defined by the level of investment in education and the quality of the basic education we provide for our children and that is why we have devoted resources to the rebuilding of our primary schools, junior and senior secondary schools.

“For me, it was clear coming from my own background, I had obligation to restore dignity to the educational sector in the state. Basic education is like the foundation of a house. If the foundation is weak, the building will collapse but if the foundation be strong, it will withstand the test of time. It is easier to re roof than to re build a complete house.

“The need to ensure the future of the state is not compromised by compromising the future of the Edo child necessitated the action to redefine the educational system in the state. The state government’s commitment to carry out competency test was informed by these broad facts having discovered that some of our teachers were not qualified or up to date with recent teaching methods. Our insistence on the fact that competency test must be seen in this light.

“However, having listened to all suggestions and consultations with various groups, government has agreed to set aside the competency or assessment test in order to re assure Edo workers that government has no intention to sack anyone.”

The governor said in place of the competency test, government would introduce training and re-training for teachers and all others civil servants in the state, promising that welfare package will be provided during the training exercise.

According to him, “On the teachers with falsified age declaration with criminal intentions to cheat, government has resolved to pardon them and retire those whose records show that  they are above 60 years while those below 60 years are to return to the classroom with their names returned to the payroll and will benefit from the training programme.

“Following investigation, the alleged ghost workers in Ovia North East Local Government Area who have been found to have actually been on ground will have their two months pending salary paid. I will discuss with the local government chairman on how to effect their payments.”

Responding, the trio of the leadership of organised labour,  Nigeria Labour Congress (NLC), Trade Union Congress (TUC), and Nigeria Union of Teachers (NUT) expressed thanks to the governor, adding that the prolonged crisis faced by leadership of the organised labour as it affects teachers and workers in the state will now be a thing of the past.

They promised to continually give their full support and allegiance to the administration of the governor, stressing that teachers in the state will now sleep with both eyes closed.

Court: Sylva, Others Must Attend Proceedings on Money Laundering Charges

A Federal High Court in Abuja has ordered that a former Bayelsa State Governor, Timipre Sylva and his co-accused persons must always attend court for the hearing of the N19.2 billion money laundering charge filed against them by the Economic and Financial Crimes Commission (EFCC).

Justice Ahmed Mohammed’s order was contained in a ruling yesterday on the arguments by the lawyers in the case on whether it was necessary for the accused persons to attend court and mount the dock even when they were challenging the court’s jurisdiction, the competence of the charge and seeking the disqualification of the prosecution lawyer, Rotimi Jacobs (SAN).

The EFCC had late last year, filed the 42-count charge, in which the ex-governor and others were accused of laundering about N19.2 billion.

Charged with Sylva are: Francis Okoburo, Gbenga S. Balogun, Samuel Ogbuku, Marlin Maritime Limited, Eat Catering Services Limited and Haloween Blue Construction and Logistics Limited.

Yesterday, while Sylva and Balogun reluctantly mounted the dock, Okoburo and Ogbuku were absent in court, prompting prosecution lawyer, A. Adeniyi to urge the court to issue bench warrants for their arrest.

Defence lawyers, including Isreal Olorundare (SAN), who represented Sylva opposed the prosecution’s application for bench warrant.

He argued that since the accused persons were challenging the court’s jurisdiction, the competence of the charge and the continued appearance of the prosecution lawyer in the case, the court must first decide the issues raised by the accused persons before proceeding to hear the charge.

He argued that since the accused persons’ applications were still pending, the court must decide them one way or the other before proceeding to take their plea.

He argued that the prosecution lawyer was currently disabled from making any application, including applying for bench warrant when his appearance in the case was being challenged.

Lawyers to Okoburo and Ogbuku, James Odiba and Ajayi Olowo apologised to the court for their client’s absence.

Odiba said his client was ill and had gone on medical trip to Senegal, while Olowo said his client was in another court in Yenagoa, Bayelsa State in respect of another criminal case involving him.

They agreed with Olorindare’s argument that pending issues raised by the accused persons against the court and the prosecutor must first be resolved before any further steps could be taken in the case.

Ruling, Justice Mohammed held that since there was a pending charge against Sylva and others, they were, by law required to attend court at every hearing despite their pending applications against the court’s jurisdiction, the charge and the prosecution lawyer.

He further held that the defence lawyer, failed in their arguments to show any legal provision that the client could stay away from court just because they have pending applications challenging the jurisdiction of the court and the competence of the charge.
The judge also held that until he decides whether or not the prosecution lawyer was competent to proceed with the case, he could not be restrained from making any application in the case, including the application for bench warrant.

He however declined to issue the bench warrant prayed for by the prosecution lawyer on the ground that the lawyers to Okoburo and Ogbuku have sufficiently explained why their clients were absent in court.

Justice Mohemmed adjourned to October 8 for hearing of the pending applications by the accused persons.

Sylva was, in a preliminary objection he filed against the charge, challenging its legitimacy and urged the court to quash it.

It is his contention that they could also not be tried before a Federal High Court in Abuja since the alleged monies they were accused of laundering belonged to Bayelsa State and not the federal government.

The ex-governor contended that it was only the Bayelsa State Government or its agent that could prosecute them, if necessary, and in Bayelsa, where the alleged offences were purportedly committed.

Balogun is, by his application, seeking primarily to disqualify Jacobs from the case.
He accused Jacobs of hiding some material facts from the court and allegedly acting in unprofessional manner.

Balogun, in a supporting affidavit, averred that the EFCC, in a motion ex-parte seeking an order of interim attachment and forfeiture of some properties purportedly owned by Sylva, included that located  at plot 1181, Thaba Tseka Crescent Wuse II Abuja, which was already a subject of litigation.

“That I know of a fact that the said properties which the complainant, through their counsel, seeks their attachment and forfeiture in their new application of March 10, 2014 with suit no FHC/ABJ/CS/188/14, are the same properties which are the subject of pending appeal at the Court of Appeal,” Balogun said.

He claimed that he was aware that material facts had been suppressed by Jacobs  and the EFCC in an alleged attempt to deceive the court to make an interim order of forfeiture of the property of the owned by Marlin Maritime Ltd (the 5th accused)  at plot 1181 Thaba Tseka Crescent Wuse II Abuja.

NIGERIA: Fashola Pleads with Doctors to End Strike

Lagos State Governor, Mr. Babatunde Fashola (SAN), yesterday appealed to the National Medical Association (NMA) to call off its strike action, citing its implication for the patients.

The governor also offered automatic employment to the 265 fresh graduates of the Lagos State College of Health Technology in Yaba, assuring that his administration would continue to employ staff in some sectors of the economy.

He disclosed this at the college’s second convocation ceremony while urging all medical workers to desist from using strike actions as a means of getting their demands met.

At the convocation, the governor argued that those that invented strikes in the country’s health sector did it for the sake of their patients and not for themselves, thereby asking the present crop of doctors to emulate the past leaders.

According to him, all medical workers from the lowest medical worker to the highest in the chain of command are like gods on earth. Only sick people and I know your importance.
He said workers in other sectors of the country’s economy “are not satisfied with their remuneration. They are not holding governments to ransom because they do not want Nigeria to fail.

He explained the importance of fresh graduates in the state’s healthcare system, noting that what delighted him “is that we are producing graduates in areas where the state economy has a compelling need. The primary healthcare is critical to the Lagos economy.

He said the state healthcare initiative was targeted at prevention, thereby offering automatic employment “to the 265 fresh graduates of the college. The state government’s primary objective is to make sure that hospitals are not filled because they ensure initially that the people do not fall sick.”

He said the state government would readily grant autonomy to the governing councils and management running institutions in the state, assuring that the government would only intervene in their affairs when it becomes inevitable.

Meanwhile, the Chief Medical Director of the University of Calabar Teaching Hospital (UCTH), Dr. Thomas Agan, has called on the federal government and the Nigeria Medical Association (NMA) to return to the negotiating table to resolve the differences that brought about the current strike by doctors.

Reacting to the strike in his office while fielding questions from journalists, the medical director described the industrial action as an ill-wind that was not doing the country’s healthcare delivery any good.

He said he was disturbed by the decision of the doctors to embark on strike without considering the sensitive nature of their job and appealed to his colleagues to suspend the strike in the interest of their patients.

“Though the issues raised are germane, it is important for the federal government and the Nigeria Medical Association to return to the round-table and revisit the issues that led to this strike in the interest of the public,’’ Agan said.

He appealed to the striking doctors to consider the plight of patients and give peace a chance even as he urged the federal government to carefully listen to and address grievances of medical doctors.

But the Chairman of NMA in Cross River State, Dr. Callistus Enyuma, has vowed that the association will not return to work until all the 24 points demands of the association were met.
He listed some of the demands to include creation of office of a Surgeon-General of the Federation as well as reviewing doctors’ salary scale “to reflect relativity in international best practices.”

Others are reserving the position of Chief Medical Director of a Federal hospital exclusively for medical doctors and ignoring the agitation by paramedics to become consultants, among others.

“Until these demands, which I must tell you are 24 are met, we will not admit new patients. However all the patients who have been in the hospital and whose cases are serious would be taken care of effectively,” he said.

NIGERIA: FG Criticises States for Not Prioritising Education

 The federal government has taken a swipe at some state governments for not prioritising educational development in their states despite the country's 10.5 million out-of-school children.

It also disclosed that the N53 billion budgeted for basic education in the states had not been accessed because of the failure of the state governments to provide counterpart funding.

The supervising Minister of Education, Chief Nyesom Wike, while speaking at the the presentation of the scorecard of the Ministry in Abuja yesterday, said such state governments only pretend to make education a priority, and have refused to take concrete steps to develop the sector.

"If they provide their counterpart funding, it means we should have about N70 billion and that would do a lot for the quality in the sector if we invest that kind of money," he said.

"It is not about you spending money to bring all the big people to come and speak in your state. It is not about going to America and bringing the democrats to come and speak, channel the money into the projects in the sector," he added.

Wike disclosed that N139 billion had been disbursed to states for education infrastructure development in the last one year with N21 billion provided for teachers' training in the states in the last four years.

Each state, he said, had received at least N588 million from the federal government since 2010 to train its teachers even though they are not in the employ of the federal government.

"But when you hear that they are training teachers, they will not admit that some of the money came from the federal government. States should be able to admit that some of their schools were built with funds from UBEC, and not from their own treasuries," he added.

Citing other achievements of the current administration in the education sector, Wike noted that the carrying capacities of universities have been increased from 400,000 in 2011 to a million.

He lamented that the Presidential Scholarship Scheme for Innovation and Development (PRESSID) which is based solely on merit had come under fire from several quarters for not taking the principle of federal character into cognisance.

Wike emphasised that the current administration had done more for the education sector than any other before it.

"When you have this kind of leadership, do you lose it? No, you hold on to that kind of leadership, because this is not easy to come by. Nigerians must hold on to what they have," he said.

Wike cited some of the challenges plaguing the sector to include lack of commitment by states and communities, security challenges and lack of viable data to support plans for development in the sector.

The Minister for Information, Mr. Labaran Maku, berated the states that had un-accessed funds, saying they contribute significantly to Nigeria's 10.5 million out-of-school children, a situation which is currently embarrassing the nation at international fora.
He added that majority of the states are from the northern states and suggested that the list of the states be published in national dailies to force the hands of the governments to access the funds with their counterpart funding.

Maku also blamed the past military governments for the decline in the education sector as there were no systematic investments during their regimes.

"Good leadership is often very difficult to accept. Those who come to make changes possible are always resisted. We must begin to admit that this country is moving forward under this president, yet he is the most abused president in the history of this nation," he said.
