Zoning tears Abia PDP apart

0 0
Read Time:1 Minute, 33 Second

The recent zoning of the governorship ticket by the leadership of the ruling Peoples Democratic Party in Abia State, ahead of 2015 to Abia-South senatorial district has torn the Ukwa/ Ngwa political bloc apart.

Investigations by The PUNCH revealed that while Ukwa/ Ngwa people from Abia-South hailed the decision, governorship aspirants from Ukwa/ Ngwa extraction in Abia-Central senatorial zone bicker.Continue after the Break…

The PDP had after its caucus meeting in Umuahia, two weeks ago, formally zoned its governorship ticket to Abia-South, declaring that the decision was “final and irreversible.”The caucus, however, noted that any aspirant from outside the zone who felt like joining the race was free to contest.

Speaking with our correspondent in Umuahia, a former governorship aspirant from Abia-South, Chief Sampson Esochaighi, called on all aspirants outside the zone to shelve their ambition and abide by the party’s decision which he said was based on equity and justice.

He argued that while other senatorial zones had taken their turns on the seat of power, “common sense demands that Abia-South should be given a chance in 2015.”

However, governorship aspirants from other Ukwa/ Ngwa communities have expressed displeasure over the zoning formula, contending that Ukwa/ Ngwa people are one.

According to them, no aspirant from Ukwa/ Ngwa should be stopped from contesting as the people have the same ancestral origin.
Ukwa/ Ngwa political bloc comprises nine out of the 17 councils in the state, but only six councils are in Abia-South while three councils- Osisioma, Isiala Ngwa-South, and Isiala Ngwa-North fall within Abia-Central.

Sources close to one of the affected aspirants, Senator Nkechi Nwogu representing Abia-Central, told our correspondent that the senator would not shelve her gubernatorial ambition as a result of the zoning.

Multiple News Sites Publis Corrections After Falling For Fake Story About Michele Bachmann

0 0
Read Time:1 Minute, 9 Second

Last week, multiple liberal news sites were forced to correct false stories claiming Rep.  Michele Bachmann (R-Minnesota) called  for "Americanization facilities" for undocumented migrants at the border.

The sites — including ThinkProgress and Crooks and Liars — based the story on a parody site called KCTV7 News that features clearly absurd stories on its home page. For example, one KCTV7 news story is titled, "Feds Spend $2.2 Million To Study Why Lesbians Are Obese."

As Raw Story pointed out on Sunday, KCTV7 appears to have copied the story from another joke site, the National Report, which published it two weeks ago.

Both outlets retracted their stories after publication and apologized for being duped.

"We sincerely regret the error," ThinkProgress wrote, doing a complete strike through the text of the original article.

Crooks and Liars argued Bachmann's outspoken conservatism made the parody believable.

"Yeah, I got pwned," the author wrote. "How sad is it that it was just this side of realistic enough to believe in the first place. When you have a reputation for making outrageous and ridiculous comments, it becomes easier and easier to believe something that should have been dismissed out of hand."

Bachmann's office did not immediately respond to a request for comment from Business Insider.

Boko Haram kidnaps wife of Cameroon’s vice PM, kills at least three

Boko Haram Clashes With Cameroon Soldiers In Cross-border Attacks

?

YAOUNDE (Reuters) – Nigerian Boko Haram militants kidnapped the wife of Cameroon's vice prime minister and killed at least three people on Sunday in a cross-border attack involving more than 200 assailants in the northern town of Kolofata, Cameroon officials said.

A local religious leader, or lamido, named Seini Boukar Lamine, who is also the town's mayor, and five members of his family were also kidnapped in a separate attack on his home.

There was no immediate claim of responsibility.

Boko Haram, an Islamist group which made international headlines with the abduction of 200 Nigerian schoolgirls in April, has stepped up cross-border attacks into Cameroon in recent weeks. Cameroon has deployed troops to its northern region, joining international efforts to combat the militants.

"I can confirm that the home of Vice Prime Minister Amadou Ali in Kolofata came under a savage attack from Boko Haram militants," government spokesman Issa Tchiroma, who is also communications minister, told Reuters by telephone.

"They unfortunately took away his wife. They also attacked the Lamido's residence and he was also kidnapped," he said, adding that at least three people were killed in the attack.

"UNQUALIFIED VIOLENCE"

Tchiroma told a press conference later on Sunday that the Cameroonian army had taken the town of Kolofata back under control after repulsing the militants, who he said had used "brutal and unqualified violence".

"We do not have all the facts in order to give full information on the exact circumstances and the victim toll of this attack," Tchiroma said on state television.

A Cameroon military commander in the region told Reuters security officials had taken the vice prime minister away to a neighboring town. He had been at home to celebrate the Muslim feast of Ramadan with his family when the attack happened.

The Sunday attack is the third Boko Haram attack in Cameroon since Friday. At least four soldiers were killed in the two previous attacks.

On Friday, some 22 suspected Boko Haram militants who had been held in Cameroon's northern hub of Maroua since March were sentenced to prison sentences ranging from 10 to 20 years. It was not immediately clear whether the attacks were related to the sentencing of the militants.

Boko Haram have killed hundreds of people this year, mostly in northeastern Nigeria, although they have bombed places across the country.

The group rejects Western-style education and is trying to carve out a de facto Islamic state in northern Nigeria. On Sunday, a bomb attack on a Catholic church in northern Nigeria's main city of Kano killed five people and wounded eight, a senior police officer said. Christian churches have been a favorite target for the militants.

The attacker threw the bomb at worshippers on their way out of the church, police commissioner Adenrele Shinaba told Reuters. Police cordoned off the scene.

In a separate incident, a female suicide bomber tried to attack police officers on the streets. She killed herself but only wounded two of the officers, Shinaba said.

Anambra Guber Poll: APC Heads For Supreme Court To Appeal Judgement

0 0
Read Time:2 Minute, 45 Second

The All Progressives Congress (APC) says it will appeal to the Supreme Court after the Court of Appeal dismissed its petition in the Anambra governorship election on Saturday. The Appeal Court sitting in Enugu hady struck out four suits filed against the All Progressives Grand Alliance (APGA) challenging the candidature of Gov.

Willie Obiano of Anambra at the November 2013 gubernatorial election. The suits were filed by the APC and the Peoples Democratic Party (PDP). The petitioners are Mr Tony Nwonye, an aspirant of the PDP at the election and an APGA governorship aspirant, Mr Chike Obidigbo. Delivering the four separate judgments on the appeals, the five-man panel led by Justice Mohammed Garba, said the appeal was struck out for incompetence and lack of merit. The court, however, affirmed the judgment delivered on June 4 by the Anambra Election Petition Tribunal in Awka, and awarded the sum of N50,000 each to the respondent in the four suits.

“Having considered the preliminary objections by the respondents and the motions filed by the appellant, I will not read the judgment word to word but will deliver it as provided by the court. “I have considered the objections raised by the counsel with regards to the first and fourth respondent, and I hereby uphold the decision made by the tribunal in Awka,” Garba said. Reacting to the judgment, the Chairman of APGA, Chief Victor Umeh, commended the judiciary for upholding the rule of law. “I am grateful to God Almighty. “The Court of Appeal in a unanimous decision dismissed all the appeals standing against our victory at the lower tribunal in Awka following our victory at the governorship election in 2013. “We were not in doubt that all these appeals will be dismissed because APGA and its candidate won the election with landslide margin with the vote of the people.

“I have always known that the election tribunal is not a Mongo Park story. You must approach the court with facts. “We are encouraged by these judgments that have affirmed the decision at Awka,” Umeh said. The Anambra Chairman of the APC, Mr Emeka Ibe, said the party would appeal the judgment of the court in a higher court. “We are happy with what they did with regards to giving the judgment within the time frame. With this, we now have basis to appeal. This court is not the final court. “The final court with respect to election petitions is the Supreme Court.

I want to say that we are going to appeal against the judgment. “We are not going to rest until the Supreme Court gives the final judgment and we will be bound by it,” Ibe said. On his part, the counsel to APC and Sen. Chris Ngige, Mr Bona Orakwe, said the party would analyse the judgment before knowing the next line of action to take. “It is most likely that we will go to the Supreme Court,” he said. The APC had filed an appeal alleging disenfranchisement of voters, invalid voters register and multiple registrations, among others, that affected the poll. Nwonye of the PDP also filed an appeal seeking the nullification of the election for alleged irregularities and disenfranchisement.

BRT Probe: Falana requests Fashola to remove Justice Adebajo as chairman

0 0
Read Time:5 Minute, 25 Second

A senior advocate of Nigeria,  Mr. Femi Falana yesterday urged the Lagos state governor,  Mr BabatundeFashola, SAN, to reconstitute the judicial commission set up by the Lagos State government to investigate the army/civilian clash which occurred along Ikorodu Road, Lagos on July 4, 2014 on the ground that its chairman, Justice Ebenezer Adebajo (rtd.) does not fit for the post.

In a petition to the Governor, Falana said Justice Adebajo will be biased in his assignment because he is already a witness in a case being prosecuted by the state government.

According to Falana, in the letter titled, “Request for re-constitution of the Judicial Commission into the army/civilian clash of July 4, 2014” and dated July 23, 2014, he explained that he opposed the inclusion of Justice Adebajo in judicial commission because his appointment is not in line with section 36(1) of the Constitution which stipulates that a court or other tribunal established by law shall be constituted in such manner as to secure its independence and impartiality.

He  therefore urged governor Fashola to remove Adebajo from the Judicial Commission to investigate the incident  that led to the alleged burning of about 3 BRT buses belonging to the Lagos State Government  and the alleged  killing of a soldier, while retaining other members of the panel.

Efforts to reach Justice Adebajo for his reaction failed as his phone was not reachable as at press time.

Falana stated, “the ground of our objection is that Justice Adebajo has been listed as a prosecution witness by the Attorney-General of Lagos State in a criminal case pending before the Lagos High Court. His lordship had complained to the Police that while he packed his car to greet a friend along Moloney Street, Lagos on March 1, 2012 he was hit by the driver of a commercial vehicle, Mr. Quadri Kasali.

“Even though the allegation confirmed that it was a traffic offence his Lordship caused the Lagos State Ministry of Justice to charge the suspect with attempted murder before the Lagos High Court. The case is currently being prosecuted  by the Attorney-General of Lagos State on the basis of the complaint of the retired judge.

“As Mr. Kasali could not afford the services of a legal practitioner for his defence  our law office decided to defend him pro bono publico. But to our utter dismay, Justice Adebajo and the Ministry of Justice ensured that the poor defendant was denied bail by both the Magistrate Court (where he was initially arraigned on a holding charge) and the High Court where he is currently being tried.

“However, we succeeded in persuading the Court of Appeal to admit the defendant to bail in the most liberal terms. Thus, Mr. Kasali was able to regain his  freedom  after he had been detained in prison custody for about 18 months”, he stated.

Femi Falana, SAN

Falana stated further, with respect to the substantive case, that two witnesses have given evidence for the prosecution while Justice Adebajo is due to testify in the matter any moment from now.

Although the trial judge, Justice Balogun has withdrawn from the matter on personal grounds, the case file has been sent to the Chief Judge for reassignment to another judge who will commence the trial de novo.

“To that extent, Justice Adebajo is disqualified from heading the aforesaid Commission of Enquiry into the army/civilian clash on the ground of likelihood of bias”,

Falana stated adding, “being a complainant and the principal witness in a case of attempted murder   arising from a traffic offence which is being  prosecuted by the Attorney-General of Lagos State,  Justice Adebajo cannot be said to be independent of the Lagos State Government with respect to the conduct of the proceedings of the Judicial Commission of Enquiry into the army/civilian clash traceable to another traffic offence .

“In other words, his lordship’s impartiality cannot be guaranteed until the conclusion of the criminal case in which he is an interested party and which is being prosecuted  by the Attorney-General of Lagos State”, he stressed.

To buttress his argument on why Justice Adebajo should be disqualified, the learned silk cited several cases including Metropolitan Properties Co. Ltd. v. Lannon(1969) 2 Q.B. 167 on likelihood of bias on the part of judges and the case of The State of Lagos v Quadri Kasali  (Charge No: LCD /212/2012) pending in the Lagos High Court in which Justice Adebajo has been listed as a prosecution witness his lordship will be led in evidence at the trial by the Attorney-General of Lagos State or any of the counsel assigned by him.

He argued that in the circumstance,  all reasonable members of the public will believe that  there will be likelihood of bias on the part of his lordship if he remains the Chairman of the Commission of Enquiry adding, “It is our submission that it offends the rules of natural justice for a  witness of the Lagos State Government in a pending criminal case to be invited to preside over an enquiry set up by the Governor of the State.

Falana recalled the questionable findings of the Justice Kalu Anya Probe Panel which blamed an “unknown soldier” for the burning of the residence of the late Fela Anikulapo-kuti at Agege motor road in Lagos State on February 17, 1977.

With regards to this development, Falana urged governor Fashola to ensure that the investigation into the incident of July 4, 2014 is conducted in strict compliance with the law, “otherwise, the constitution of the Commission investigating the commotion  caused by the soldiers may be successfully challenged in the Lagos High Court by any of the aggrieved parties or concerned members of the public.”

“Having regard to the facts and circumstances of the Kasali case, we urge Your Excellency to reconstitute the membership of the Commission of Enquiry  in conformity with the provisions of section 36 (1) of the Constitution. As justice should not only be done but seen to have been done. Your Excellency may wish to replace Justice Adebajo with another retired judge  as the Chairman of the Commission”, he stated.
