Alleged $8.395m Fraud: Appeal Court Grants Ajudua Bail

Reprieve came the way of  one-time Lagos socialite, Mr. Fred Ajudua, on Friday as the Court of Appeal sitting in Lagos set aside the decision of a Lagos High Court, which had denied the defendant bail in a fraud case preferred against him by the Economic and Financial Crimes Commission (EFCC).

Ajudua is standing trial before Justice Oluwatoyin Ipaye of an Ikeja High Court over an $8.3m fraud allegation preferred against him by the EFCC.

Justice Ipaye had refused Ajuduas bail application to seek medical treatment abroad on the ground of his antecedents in separate criminal matters before another Lagos State High Court where the defendant not only jumped bail but also allegedly interfered with the court process.

Dissatisfied, Ajudua through his lawyer, Mr. Olalekan Ojo, appealed against the ruling and urged the appellate court to set it aside.
But the Court of Appeal in its lead judgment delivered by Justice Rita Pemu on Friday held that Ajudua could only stand trial if preserved alive.

The appellate court in judgment, which was unanimously adopted by Justices C.E Iyizoba and J.Y Tukur insisted that the charge made against Ajudua by the anti-graft agency did not attract capital punishment, hence it was a bailable offence.

The court observed from the medical report presented at the lower court that Ajudua had been a patient at the Lagos University Teaching Hospital for kidney related illness since as far back as 1987.

“He was already a sick man at the time the charge was filed against him. The lower court turned a blind eye on the plight of the appellant.
“A man with just one kidney is a walking carcass. Although his reputation is found wanting, he has not been convicted. The court ought to show mercy as a result of his health challenges,” Justice Pemu held.

On the claim by the EFCC that Ajudua would interfere with witnesses, Justice Pemu held that the anti-graft agency failed to show any calculated attempt made by the appellant to do so.

The court therefore granted Ajudua bail in the sum of N10m with two sureties in like sum.

The sureties, according to the court must have property worth N50 million in Lagos.

Justice Pemu also directed that Ajudua should sign an undertaking that he would remain in Nigeria throughout his trial, unless there was need for him to travel abroad for treatment.

The appellate court, however, dismissed Ajuduas appeal marked CA/L/693A on the refusal of the lower court to allow him make extra-judicial statement in response to the allegations levelled against him.
Justice Pemu affirmed the decision of the lower court on the ground that Ajudua was given the opportunity to make statements but he chose not to do so.

"It is the appellants constitutional right but he chose to waive it. The court cannot teach the Police how to carry out its investigation. The court cannot also force defendant to make statement, Justice Pemu held.

Job Creation: Ondo Engages 900 in Electrical Engineering, ICT

As part of its determination to reduce graduate unemployment among its youths, the Ondo State government has engaged 900 unemployed graduates in the area of Information and Communication Technology (ICT) and Electrical Engineering.

A statement issued by the state Commissioner for Information, Hon. Kayode Akinmade explained that among the lot, 100 first degree holders in Electrical Engineering had been engaged through a Federal Ministry of Power assisted programme after a training in Abuja.

Another set of 800, he said,  on Friday concluded a one-day training on ICT in Akure , the state capital, following which jobs would be provided for them based on their proficiency  in the same area of skill acquisition..

The training was done in conjunction with the Federal Ministry of Communication Technology and    Rockefeller foundation.
Mr Iroju Ogundeji, the commissioner for employment and productivity, represented by the ministry’s permanent secretary, Mr. Olushola Omotosho at the opening ceremony of the Akure training workshop thanked the minister of communication Technology, Mrs.Omobola Johnson for her deep interest in the State and for selecting the state as one of those to benefit from the Programme.                 

Iroju particularly appreciates the efforts of Governor, Olusegun Mimiko for what he described as his financial support to the ministry in ensuring that the problem of unemployment in the state was brought to an end through various programmes for poverty reduction, youth empowerment programmes.        

The commissioner said it was on record that the state government through the ministry and other agencies had made great impact through the training of appreciable number of youths in various skills and by giving them low interest loans to make them employers of labour rather than seekers of employment.

He therefore charged the participants across the 18 local government areas of the state to see the ICT training as a rare opportunity and to explore every available benefit realisable from it.                                                    

Speaking at the training, Mr Ugochukwu Nwosu of Rockfeller Foundation said unemployment is real and that it is a global problem where the few jobs that are available cannot go round the teeming qualified population, adding that the on line work is one of the work that one can do easily from any location via a computer with internet connection.

Ugochukwu stated some benefits of online jobs to include consistent income, access to basic needs of life, social relevance among others.   One of the participants Kola Lawrence a graduate of History and International studies from Adekunle Ajasin University, Akungba Akoko who hails from Ile- Oluji Okeigbo thanked the government for organising the programme, which he described as very laudable for unemployed graduates in the state.

N25bn Fraud: Igbinedion, Others Know Fate January 30

A Federal High Court sitting in Benin, Edo State, on Friday reserved ruling in the N25 billion money laundering and abuse of office charge brought against Michael Igbinedion and Charles Eboigbodin by the Economic and Financial Crimes Commission, EFCC, for January 30, 2015.

Justice J. Liman fixed January 30 date for judgement after the adoption of written addresses by counsel, Rotimi Jacob, SAN, for the prosecution and Mike Ozekhome, SAN, Ricky Tafa, SAN, and Mr. Richard O. Ahonaruogo for the accused persons.

The accused persons along with their companies: Gava Corporation Limited; Romrig Nigeria Limited; PML Securities Company Limited and PML Nigeria Limited, were arraigned by the anti-graft agency on a 81-count charge bothering on money laundering, misappropriation of funds, conspiracy and Abuse of office.

While addressing the court, Jacobs hinged his submission on the testimonies of prosecution witnesses which, according to him, corroborated the charge, with emphasis on the several public funds deposited into private accounts, and how government funds were used to repay loans collected by former governor Lucky Igbinedion while he was in office.

Jacobs then prayed the court to “accept the prosecution’s case as presented and convict the accused persons as charged”.
But before closing his address, the prosecuting counsel called the attention of the court to the inability of the bailiff to serve the summon earlier issued by it on the former Edo State governor, who failed to present himself in court, after the Appeal Court decision in April, asking him to return to the High Court for trial.

Jacobs disclosed that all efforts by the bailiff to serve Lucky Igbinedion with the summon, met a brick wall as  he was always turned back from the gate by security men who told him on all occasions that Igbinedion was out of town.

The EFCC counsel then prayed the court to permit a substituted service of the summon on the last known address of Igbinedion.
“May I apply that the first accused person be served by allowing the prosecution paste the notice at the known address,” he said.
But Justice Liman advised the prosecuting counsel to make an application. According to him, “the summon has expired, you can reapply or ask for a substituted service as there are other means of service. Prosecution must make another application.

NIGERIA: Uduaghan Hails Chevron for Donating Medical Equipment

Governor Emmanuel Uduaghan of Delta State has commended Chevron Nigeria Limited for donating medical equipment worth millions of naira to Delta state government to boost healthcare delivery in the state.

Chevron’s Managing Director, Policy, Government and Public Affairs, Mr.  Deji Haastrup, who made the donation yesterday  in Asaba,   pointed out that the medical equipment should  be used to upgrade services in health institutions in the state.

Items donated are;    150 cartons of examination gloves, 150 non contact thermometers, 200 goggles, 40 disposable facemasks, 300 plastic buckets, 300 plastic receptacle, 100 footwear boots and 500 disposable aprons.

Other items are four LCD television sets, 10 elbow length gloves, 2 motorised bed, 1500 disposable dupont cover tyvek and 8 wheel chairs.

Hasstrup said the donations were a part of the Joint Venture’s social investments in the area of health for the benefit of Deltans

Haastrup  who was represented  government Affairs Adviser , Mr. Dan Agbofode,  said  the gestures  was aimed at “demonstrating  our support for the government in its efforts to provide qualitative Medicare for the people”.

“You will recall that we were here on September 18 this year to present a Ford Transit ambulance to the State Government also in support to this cause.

“Chevron believes that good health holds the vital keys to the sustainable development of any society. This donation of medical goods is part of our social investments in the area of health for the benefit of the country.

“We have partnered with the State government to implement various health program including the Roll Back Malaria, Mass deworming of school children and donation of essential drugs to some hospitals.

“We have also provided funds for the development of four (4) cottage hospitals in some communities through Regional Development Committees (RDCs) under our Global Memorandum of Understanding (GMoU) with the relevant communities.

“Also, in partnership with the State Government, we launched the River boat Clinic (a mobile health service) in 2001 to serve communities along the Escravos and Benin rivers. The boat equipped with a full complement of medical supplies and personnel has continued to visit the riverine areas where treatment is delivered at no cost to local communities.

“The floating clinic has helped thousands of patients in those communities. As at October 2014, the River Boat clinic, for this year, has directly benefitted over 25,000 people in 14 communities’ who received treatment for various illnesses. This figure includes children less than five years who were immunised against killer diseases.”

He explained that in 2010 and 2011, Star Deepwater Petroleum Limited (a Chevron company) and its Agbami partners handed over to Delta State government a chest clinic donated to the Tuberculosis and Leprosy Referral Center Eku, and a Science laboratory donated to Zik’s Senior Secondary School Sapele, respectively.

He  commend the Federal Ministry of Health, Delta State Ministry of Health, the Port Health Authorities and the Aviation Ministry, who have continued to sustain efforts in eradicating communicable diseases in Nigeria”, he said.

Governor Uduaghan while receiving the donated items    commended the noble gesture of Chevron Nigeria Limited for the donation of medical equipment

Uduaghan who was represented by the Commissioner for Health , Dr. Joseph Otumara  noted that the provision of medical equipment in public hospital was a big and too expensive venture to be left with the government alone hence the donation of the medical equipment by Chevron Nigeria Limited should be appreciated against that background adding that the both the private and the government collaborate in this regard.

Expressing optimism that the donated items would be judiciously utilised, he assured that his government would continue to collaborate effectively with all partners to achieve positive results in the health care delivery system and thus improve the life expectancy of all Nigerians.
