A High Court of the Federal Capital Territory (FCT) sitting in Abuja has summoned the Secretary General of the Conference of Nigerian Political Parties (CNPP), Chief Willy Ezugwu to appear before it over a libel suit instituted against him by the Managing Director of NEXIM Bank, Mr. Roberts Ungwaga Orya. In a writ of summons obtained by THISDAY, the court handed down an eight-day ultimatum to Ezugwu to appear before it, failing which the court may proceed and enter give judgment in his absence.
The plaintiff’s claim, according to the writ of summons dated May 20, 2014, and issued by a legal practitioner, FR Onoja, is for damages in the sum of N600million for alleged libel contained in a press release issued by the defendant.
The plaintiff is also seeking for “an order of perpetual injunction restraining the defendant, whether by himself, his servants, agents, privies, associates, friends or otherwise from further publishing or causing to be published the said words or any words similarly defamatory of the plaintiff.”
Ezugwu was quoted in a recent media report as calling for the immediate suspension of Orya from his position as the Managing Director of NEXIM, for alleged “dereliction of duty, gross abuse of office and misapplication of the N200billion stabilisation and loan guarantee fund advanced the agency by the Central Bank of Nigeria (CBN).”
Ezugwu, on behalf of CNPP reportedly alleged that Orya “has turned NEXIM that promotes investment and stimulates national industrialisation drive in the import and export sector into a personal fiefdom through the recruitment of unqualified staff, alienation of directorate and executive staff in the decision making process, favouritism in the grant of loans and gross misapplication of agency fund.”
