NIGERIA: Okah Rejects Medical Report, Seeks Independent Evaluation

An alleged 2010 Independence Day bomber, Mr. Charles Okah, has rejected a medical report on his state of health carried out by the government.
 
Okah has also filed an application asking that an independent medical team be allowed to evaluate his health.
 
In a motion on notice filed at the Federal High Court, Abuja by his lawyer, Mr. John Ainetor, Okah said  an independent medical evaluation would be the most appropriate in the circumstance.
 
When trial resumed yesterday, the report of a court-ordered medical examination of Okah was handed to his lawyer, Anietor, and the prosecutor, Dr. Alex Izinyon (SAN).
 
The trial judge, Justice Gabriel Kolawole, had ordered that three psychiatric specialists from the National Hospital Abuja should examine the mental status of  Okah to ascertain his real state of health and to know if he could stand trial.
 
He is charged with one-count charge with 22 particulars of overt acts of treason and another eight-count charge of terrorism.
 
When the medical report was given to the trial judge, he examined it after which he gave it to the  prosecutor, Izinyon, who in turn gave it to the defence counsel  Ainetor to read through.
 
After perusing the report, Ainetor's move to react was averted by the court on the grounds that a person's medical report should not be discussed  in the public.
 
The court therefore urged both counsel to pick a date for the commencement of the trial.
 
At this juncture, Okah's lawyer informed the court of his pending application seeking an independent medical examination of the suspect.
The application which was brought under Sections 36 (6) (b) and Section (6) (6)(b) of the 1999 Constitution (as amended), sought an order of the court granting leave to Okah to be examined by an independent private medical practitioner to ascertain his mental and physical health status.
 
The application also sought an order of court granting leave for an independent private medical practitioner to produce a medical/scientific analysis/report on the side effect of Epilim Sodium Valproate (ESV) on Okah.
 
"There is need for the 1st accused person (Charles Tombra Okah) to be examined by an independent private medical practitioner, for an impartial neutral confirmation of the medical reports from both the Kuje Prisons Clinic and National Hospital Abuja, to ascertain the mental and physical health status of the 1st accused person," Ainetor stated.
