13 Years After, Senate Reinstates Dismissed Naval Officer

Hope came the way of an ex-Naval officer, Lt. Yahaya Yakubu, who was dismissed by the Nigeria Navy in 2001 as the Senate on Tuesday ordered his immediate reinstatement.
 
His reinstatement followed the adoption of the report of Senate Committee on Ethics, Privileges and Public Petitions, which recommended his reinstatement after obtaining and investigating his petition.
 
Yakubu, according to the report, was recommended for dismissal by the Navy Court Martial after finding him guilty of allegations of conspiracy and stealing of 5, 800 litres of diesel in 2001.
 
The report, which was made available to journalists on Wednesday, decried Yakubu's treatment by the Nigerian Navy, stating that prior to his trial, he was thrown into the prison in chains at gun point for as long as 11 months before his dismissal was eventually ratified by the Nigerian Navy Board.
 
Yakubu who graduated in Marine Engineering at the Nigeria Defence Academy (NDA) in 1994, was until his dismissal, serving at the Eastern Naval Command of the Nigerian Navy.
 
The report further said Yakubu, having been dissatisfied by the judgment, challenged it at the Court of Appeal in Calabar.
The appellate court, the report added, reviewed the judgment, highlighted some controversial areas and consequently nullified the verdict of the court martial.
 
The appellate court, the report further said, observed that members of the General Court Martial violated Yakubu's right to fair hearing, failed to administer an oath and did not sign the judgment.
 
The committee chairman, Senator Ayo Akinyelure (Ondo Central), while presenting the report to the Senate on Tuesday, noted that following the judgment of the Court of Appeal which favoured Yakubu, the Nigerian Navy opted to convert Yakubu's dismissal to retirement, insisting that his services were no longer required.
 
This prompted his petition to the Senate in 2011 and following the adoption of the report of the Committee on Ethics and Privileges, the parliament ordered the reinstatement of Yakubu with the option of voluntary retirement with full benefits.
