OSOGBO—With less than 24 hours to the South-West zonal congress of Peoples Democratic Party, PDP, scheduled to hold in Ibadan, Oyo state capital tomorrow, the party, yesterday, failed to comply with  the order of an Osun State High Court restraining it from filling the position of National Secretary of the party at its mini-convention.
The South West zone of the party had fixed tomorrow for its congress saying representatives of the zone at the mini- national convention of the party are expected to emerge.
Former National Secretary of the party, Prince Olagunsoye Oyinlola, had on August 1, this year, sought an order of the court stopping the election into the office of the National Secretary of the party.
Ruling on the exparte motion, Justice Falola restrained parties involved in the matter from conducting election into the office of National Secretary of the party earlier occupied by Oyinlola before a Federal high court, Abuja, nullified his election.
At yesterday’s hearing, however, Justice Adeleke who presided over the court, declined hearing the motion exparte earlier granted by Justice Oyejide Falola who had been handling the matter before his transfer to Ikirun division of the court.
Oyinlola had claimed in his application that his removal through the verdict by Justice Abdul Kafarati of an Abuja high court on January 13, 2013, was being challenged before the Court of Appeal and hearing in the suit, according to his counsel, Realwan Okpanachi, is due to commence by September this year.
Counsel to Alhaji Ganiyu Olaoluwa, the state chairman of the party, Mr Sunday Ojo-Williams, informed the court of an application for preliminary objection to the motion exparte stopping conduct of election for the office of national secretary of PDP.
But, counsel to Oyinlola and the chairman of the party’s mini-convention committee, Professor Jerry Gana, Messrs Okpanachi and Yamta Yusuf respectively, indicated their readiness to respond to the preliminary objection.
In his ruling Justice Adeleke told the parties that the matter could not go on because it was new to him, saying he needed time to study the case file.
He then warned parties involved in the matter to maintain status quo pending the determination of the suit and subsequently adjourned the case till Wednesday, September 18 for hearing of the application.
