INEC Overrules PDP on Suspension of Oyinlola, Baraje, Others

The crisis rocking the Peoples Democratic Party (PDP) is gradually getting complicated as the Independent National Electoral Commission (INEC) yesterday said due process was not followed in the suspension of the four chieftains of the party.
 
INEC in a letter signed by its Secretary, Mrs. Augusta Ogakwu, dated November 25, with reference number INEC /EPM/PDP/02/024/Vol.T/161 and titled: ‘Re: Suspension of Alhaji Abubakar Baraje, Dr. Sam Sam Jaja, Prince Olagunsoye Oyinlola and Ambassador Ibrahim Karaure from the PDP”, said no notice of meeting for the suspension was provided to the commission.
 
The letter, addressed to the National Chairman of the PDP, read in part: “This is to acknowledge the receipt of your letter dated November 12, 2013 informing the commission on the suspension of four members of your party.
 
“The commission notes that some of the individuals so suspended held positions covered by the provisions of section 85(1) of the Electoral Act 2010 (as amended) and that no notice of the meeting which approved their suspension was provided to the commission.
 
“Accordingly, the records of the commission does not reflect the process and composition of the meeting that approved the suspension of the individuals, as such, the commission cannot establish an informed position on the matter
 
“Please accept the commission’s highest regard and consideration.”
Section 85 (1) of the Electoral Act 2010 (as amended)  stated thus, ‘Every registered political party shall give the commission at least 21 days notice of any convention, congress, conference or meeting convened for the purpose of electing members of its executive committees, other governing bodies or nominating candidates for any of the elective offices specified under this Act.’”
 
When THISDAY visited the INEC website at 9.10p.m., the website displayed the name of Charles Akitoye as the national secretary. It was silent on the name of Prof. Olawale Oladipo as the national secretary.
 
Oyinlola was reinstated by the Court of Appeal, but PDP instead of reinstating him hurriedly suspended him with three others for anti-party activities.
To make matters worse, the National Disciplinary Committee led by Dr. Umaru Dikko, also recommended their expulsion.
 
Meanwhile, the National Chairman of the PDP, Alhaji Bamanga Tukur, has said the party would field President Goodluck Jonathan in the 2015 general election, adding that the president would be re-elected for another tenure.
 
Tukur said this yesterday at the inauguration of the pioneer national executive council and state chairmen of the National PDP’s Councillors’ Forum in Abuja.
He noted that the PDP remains the strongest party in Nigeria as it registers its presence in every part of the country.
 
He explained that only a strong party can liberate the nation and ensure economic development.
“A strong party brings strong government, a strong government brings strong economy, a  strong economy brings development for everybody,” he said.
Tukur added that the PDP believes in justice and fairness and everyone is a stakeholder in the party.
 
He, however, urged the councillors to remain resolute in their mobilisation and support for the party, as he said they remain the engine room of the party at the grassroots.
The chairman also enjoined the councillors not to feel jittery about the recent exit of some state governors from the party.
 
He said those who defected were mere individuals whose exit would mean little or no harm to the success of the party.
 
“Our party believes in justice and fair play, our party believes in reconciliation without any confrontation, our party believes in rebuilding based on equity and justice, consensus not imposition, each an every one of you here is a shareholder in our big party.
 
"Go back to your own village or council, don’t be deterred by some people saying that they are leaving the party, those people leaving the party are individuals, it doesn’t mean that if you leave the party, the party dies, the party is there, it is the only party that gives a candidate in every election, in anywhere in Nigeria, you find a member of the PDP don’t be deterred,” he added.
When asked to give comments on the 18-page letter addressed to President Goodluck Jonathan by former President Olusegun Obasanjo, Tukur said the letter was not addressed to him an as such should not attract his response.
 
“I don’t need to say anything, because Obasanjo has not written to me, go and ask him,” he said.
The PDP chairman insisted that the Jonathan would be returned come 2015 general election.
“He will be returned, This is a ruling party and he is our president, he is the president of PDP, the Nigerians are here, over 6,000 from the local councils, this is the first tear of the PDP family, and I can assure you that in every vote in the country, the PDP is the only party that field candidates in all these votes,” stated.
 
At the event, the chairman of the occasion and former governor of Bayelsa State  Diepreye Alameyeiseya stated that the PDP councillors should work assiduously to ensure victory for President Jonathans, come 2015. According to Alameyeiseya there was no greater task for the forum that to ensure victory for the president.
 
He said the councillors with their good conduct, possess the capacity to ensure victory for the PDP.
“My grandfather in the village does not know the president or the governor, but they know you, with your good conduct people will follow your party. And if you refuse to deliver the party, you will be out of job for 4 years and for been out of job, your wife can even divorce you,” he said.

Anenih Runs from Journalists

The Chairman, Board of Trustees (BoT) of the ruling Peoples Democratic Party (PDP), Chief Tony Anenih, may have been thrown into confusion and silence over the happenings in the country in the last one week as he now keeps to himself.
 
The PDP chieftain, known in political circle as “Mr. Fix It” virtually ran away from journalists yesterday at the Presidential Villa, Abuja shortly after he had held a consultation meeting with Vice-President Namadi Sambo.
 
According to an online news medium, Greenbarge Reporters, journalists, including television and newspaper cameramen, had lain in waiting for him at the entrance to the vice-president’s wing of the Presidential Villa with barrage of questions on some of the issues that had arisen within the PDP and in Nigeria during the week.
 
The questions bordered on the damning letter from the former President Olusegun Obasanjo to President Goodluck Jonathan which caused political waves between yesterday and today, the issue of the G-5 governors that had since defected to the opposition All Progressives Congress (APC), the agitation for the resignation of Bamanga Tukur as the national chairman of PDP and the failed dialogue President Jonathan had with the remaining G-2 governors last Sunday.
 
When Anenih emerged from the vice-president’s office, he was confronted with such questions but he never answered any.
 
Rather, he pushed through a cream of journalists and cameramen that were blocking his way and preventing him from moving pass them so as to obtain at least, a cough from him.
He made sure that his lips were gummed together even as his security detailed assisted him in cordoning off the journalists to make way for him to go away.

Police Bar Rivers Lawmakers from Assembly Complex

The police in Port Harcourt Thursday used tear gas to disperse pro-Governor Chibuike Amaechi members of the Rivers State House of Assembly, who attempted to gain access to the Assembly complex.
 
This came as the state chapter of the All Progressives Congress (APC) has said it would not accept the judgment of the Federal High Court Abuja, which asked the National Assembly to hands off the functions of the assembly.
 
The police had cordoned off both ends of Moscow Road where the assembly complex and headquarters of the state police command are located as early as 7a.m. before the lawmakers arrived.
 
As 22 lawmakers, led by the Deputy Speaker of the assembly, Mr. Leyii Kwanee, got to the Port Harcourt City Council end of Moscow Road, armed regular and riot policemen prevented them from going further towards the complex.
 
The police also stationed about 20 patrol vans and armoured personnel carriers (APCs) around the vicinity of the assembly complex.
 
Entreaties by the lawmakers to persuade the police to allow them access to the assembly or to see the Commissioner of Police, Mr. Joseph Mbu, did not yield any result as the police insisted that they had not received any certified true copy of the judgment of the Federal High Court on the assembly.
 
As the face-off between the lawmakers and the police lingered, the police Area Commander, Aliyu Garba, arrived the scene and took over discussions with the legislators.
The Deputy Speaker, Kwanee, presented two demands to the area commander: that they pay a courtesy call on Mbu and to visit the assembly complex to inspect the facilities at the complex.
At this point, Garba advised the lawmakers to formally write to the commissioner of police for a courtesy visit.
 
He also told the lawmakers that it would not be possible for them to visit the assembly complex as the police had not been ordered to vacate the premises.
 
When the lawmakers did not have any headway in the dialogue, Kwanee addressed journalists behind the police barricade. He said the action of the police amounted to impunity, adding that the people would resist any attempt by the police to scuttle democracy in the state.
 
He lamented that it was surprising that the commissioner of police would prevent them from performing their functions even after a court of competent jurisdiction had delivered judgment.
“We condemn this act of impunity in Rivers State. We are prepared to risk our lives to defend democracy. We want to assure you that the 25 pro-Amaechi lawmakers are intact.”
 
The lawmaker representing Eleme Constituency, John Olu, also said, “Yesterday (Wednesday), the High Court in Abuja gave a judgment and we are in tune with that judgment. I am here with over 20 of my colleagues and we are ready to work. Initially, they were saying we are afraid and we wanted to hand over our duties to the National Assembly.
 
“People should hear us and hear us very well. People cannot continue to operate in impunity, it is totally unacceptable. We will resist it.
“Hell will be let loose if the police allow the five opposition lawmakers to go into the assembly and conduct any proceeding intended to impeach Governor Amaechi.”
 
Chief of Staff, Government House, Port Harcourt, Chief Tony Okocha, who was also prevented from going through the police cordon, also said: “We are not a violent people. The moment we are sure that the police have not allowed the opposition lawmakers to go into the chamber of the House to conduct any proceeding, we will go back home”.
 
The interim state Chairman of the APC, Dr. Davis Biamau, lamented: “You see how power is being used against the people. The majority of the lawmakers in the state House of Assembly want to visit the commissioner of police, but the police have refused to allow them see the Commissioner of police, Mbu Joseph Mbu.
 
Meanwhile, Hon. Evans Bipi, who was picked as speaker by the five anti-Amaechi lawmakers, said he had no plans to impeach Amaechi, but called on the governor to recognise him as the speaker of the assembly.
 
“I remain the authentic speaker of the state assembly and I must say that I do not have any plan to impeach Amaechi. He (Amaechi) is my governor, but I want him to address me as speaker and I will work with him,” he said.
 
Bipi wondered why the pro-Amaechi lawmakers were in a hurry to resume sitting, when the police had not been served the court judgment to re-open the assembly.
 
Reacting to the incident, the state chapter of the Peoples Democratic Party (PDP), said the police was right to have refused the lawmakers access to the assembly complex.
 
It also blamed Amaechi for hiring thugs to escort the lawmakers and occupy the assembly.
In the same vein, the state chapter of APC has said: “We are surprised that the court could render this kind of verdict despite the persisting threat to life and peace in Rivers State as a result of the unpatriotic and sponsored activities of a few members of the Rivers House of Assembly which informed the decision of the National Assembly to take over the functions of the House. We are convinced that this decision is not in the interest of the good people of Rivers State and have, therefore, instructed our lawyers to immediately appeal against it.
 
“We wish to alert the Nigerian public about the imminent breakdown of law and order in Rivers State if the judgment of his Lordship, Justice Ahmed Mohammed, is allowed to stand.

Jega: We Have Learnt Our Lessons from Anambra Guber Election

Chairman of the Independent National Electoral Commission (INEC), Prof. Attahiru Jega, Thursday said the commission had learnt its lessons with the outcome of the November 16 governorship election in Anambra State.
 
  Jega declared that subsequent elections in the country would be devoid of the irregularities that marred the state governorship election that eventually resulted in a supplementary election on November 30.
 
The INEC chairman  spoke while declaring open the fourth quarterly meeting of the electoral body with all the Resident Electoral Commissioners (RECs) from the 36 states of the federation and the Federal Capital Territory.
 
He said the commission had learnt a huge lesson from what happened in the state, stating  that concerted efforts are being  put in place to ensure that such does not repeat both in the Ekiti and Osun States governorship elections in 2014 as well as the much talked about 2015 general elections."
 
According to the INEC chairman, “I want to state that as a commission we have learnt a lot of lessons from what happened in Anambra State and we are going to put such knowledge into use as we get ready to conduct other elections in the country starting with the governorship elections in Ekiti and Osun States next year and I want to urge us all to do our best as we get ready because the Anambra State lessons would be factored in our preparations.”
 
The INEC boss further revealed that to test run the 2015 general election, there was the need to ensure that certain anomalies would be avoided in Ekiti and Osun State adding that he was prepared to make them unique with remarkable improvement from what has existed.
 
The irregularities observed in the Anambra State governorship election notwithstanding, Jega praised the efforts of the staff of INEC in conducting elections in the country and appealed to all stakeholders to join hands with the commission to ensure free, fair and credible elections in subsequent elections in the country.
 
Jega explained that there was little the electoral body could do if the Nigerian people do not collaborate with it in promoting the culture of credible elections.
 
“As a commission, we are urging all stakeholders to partner and collaborate with us to make 2015 very credible and successful, our job is challenging but we must continue to do our best because the Nigerian people want free, fair and credible elections and that we must continue to give them even as we acknowledge that it takes a lot of resources and efforts to meet up with the demand of everybody,” the INEC chairman added.
 
Jega said in order to ensure that nothing goes wrong in 2015,  the commission in the past two days organised a seminar for its top management as well as the RECs with a view to identifying the risk factors that do erode the credibility of elections as well as finding the appropriate means to avoid them.
 
He also used the opportunity to state that before the 2015 elections, the issue of continuous voters' register would be concluded to ensure that those who had just turned 18 since the last exercise and some others who were left out due to one reason or the other were captured.  Jega also explained that the issue of delimitation of constituencies was receiving attention and would be completed before the 2015 general elections.

Tributes as Plateau Court Holds Valedictory Session for Lar

More tributes poured out yesterday for the first civilian Governor of Plateau State, Chief Solomon Lar, during a valedictory session for him at the state High Court in Jos.
 
The state Attorney General and Commissioner for Justice,Edward Pwajok, had after paying tribute, raised among other motions, that the state’s Chief Judge, Justice Lazarus Dakyen, grant that the lined up funeral rites be performed before the mortal remains of Lar be taken to Langtang for burial today.
 
The motion was supported by the state chapter of the Nigerian Bar Association (NBA), when its Chairman, Ladak Dafer, also gave a glowing tribute to the deceased, who was also one of them.
 
Thereafter, various dignitaries, including Governor Jonah Jang, his Bauchi counterpart, Mallam Isa Yuguda, chairman of the burial committee, Professor Jerry Gana, and Lar’s family took turn to extol the virtues of the first National Chairman of the Peoples Democratic Party (PDP).
 
Lar was praised for establishing Nomadic Education for the Fulani, and for establishing the first Customary Court of Appeal in the state, and also the first state High Court outside Jos city in the state. He was identified as a co-founder of the Nigerian Legal Aid Council to give free legal services and access to justice to the poor.
 
While Gana described him as a man of great vision, who understood the yearnings of his people and identified with them.
 
Yuguda said he was a man of love and peace, from whom he drew wise counsel. Others described him as Nelson Mandela for democracy, who gave his all to ensure that the oppressed were liberated.
 
The deputy Governor of the state, Mr. Ignatius Longjan, who represented the governor, recalled his last moment with the deceased, whom he said had invited him to his house to discuss certain things with him before his trip to the United States where he finally passed on.
 
His daughter, Hon. Beni Lar, while giving a vote of thanks, also described him as a quintessential family man, who meant many things to many people.  For her, she learnt politics and selflessness from her father.
Lar’s body was later taken to Government House chapel, Rayfield and headquarters of Church of Christ in Nations (COCIN) for lying in state and a service of songs by the family respectively.

Report: 80% of Arms in Private Hands, Illegal

A report has revealed that all parts of Nigeria are ravaged with armed violence, which has been detrimental to the socio-economic well-being of the country, with 80 per cent of weapons in private hands having been acquired illegally.
 
The report, titled: 'The Violent Road', which was presented to the media in Abuja yesterday, was conducted by the National Working Group on Armed Violence (NWGAV) in conjunction with the United Kingdom based Non Governmental Organisation (NGO), Action on Armed Violence (AOAV).
According to the Director, AOAV, Mr. Iain Overton, there is pervasive proliferation of illegal arms in the country, most of them in private hands.
 
Overton raised the alarm at the high rate of impunity involved in committing armed violence in the country, with illegal arms dealers operating in the country unchecked.
He noted with bewilderment that the high percentage of violence were being repeatedly perpetrated by those who have done it before without being prosecuted.
 
To combat armed violence, he emphasised the recommendations of the report, demanding that more needs to be done in the country with regard to weapons stockpile management; marking and tracing of small arms; and that Nigerian institutions should open up the disarmament process to greater review and transparency.
 
Overton said: "The report highlights the need for civil society in Nigeria to focus on the small arms, ECOWAS convention and the recent Arms Trade Treaty and that their lobbying needs to be ramped up for the domestication of the convention and treaty in Nigeria.
 
"The report also highlights an endemic level of impunity for many of those involved in committing armed violence in Nigeria. The findings showed that high percentage of those involved in armed violence are former offenders and that over 80 per cent of private possession of arms are illegally acquired."
 
"The conclusion is simple: perpetrators of violence should be brought to justice irrespective of who they are. This highlights the need for perpetrators of armed violence to be more rigorously brought to justice. Impunity will only be combated with a rigorous analysis of the existing judicial system."
Also speaking, the chairperson of NWGOV, Ms Mimidoo Achakpa warned that armed violence had damaged the economic and social well-being of the country.
 
Achakpa said the organisation looked at how armed violence impacts Nigeria, with a particular focus on 18 states in the six regions of the country including the Federal Capital Territory (FCT).
 
She listed drivers of armed violence in the country with North-central at the fore front, to include pervasive ethno-religious dispute; electoral political thuggery; assassinations; terrorism; and the widespread and affordable presence of small arms and other weapons.
 
"Drugs and other factors such as endemic poverty were also cited in the report as being drivers.
"It stressed how violent attacks by Boko Haram are hugely impactful, with Kano, Kaduna and Sokoto States affected since 2012. In this vein, the report highlighted that the North-Central region has some highest national levels of violence with communal militias being involved in over 40 per cent of incidents of political violence and over 75 per cent of conflict related fatalities there," she added.
 
The 24-page report also disclosed that porous borders within the North East zone had made it possible for influx of weapons from different countries; that the South-south's conflict was inextricably linked to oil exploration; while armed violence in the South West largely manifests itself in the form of political violence; and that across the nation there are frequent, and often unreported clashes between nomads and indigenes.

SNEPCO Lifts Old People’s Home in Lagos

As parts of its giving back initiatives, Shell Nigeria Exploration and Productivity Company SNEPCO, a subsidiary of Shell Petroleum has inaugurated a renovated part of the Old People’s Home, located in Yaba area of Lagos.
 
According to the company, it embarked on the project to contribute to the wellbeing of the old men and women living in the home.
 
Speaking at the event which coincided with the organisation’s end of the year party held within the premises, the managing director of the company, Mr. Chike Onebekwe, said the project was not the first project handled by the company and pointed out that the company had last year,  donated a 30KVA generator for the home.
 
On what informed the renovation of the six rooms, which were handed over to the managers of the home, the MD simply said it was renovated to accommodate more inmates and give the old people a conducive environment to live.
 
He said; “We are pleased to identify with children with special needs and senior citizens as part of our social investments portfolio which cuts across health, education and social services. Just recently, SNEPCO identified with children with special needs at Modupe Cole Memorial Childcare, Lagos by expanding and equipping a physiotherapy unit. And as it is being done here today, we were in Modupe Cole last year for the end of the year party.”
 
Speaking further, he disclosed that the company would also provide an alternative source of electricity through inverter and equip the renovated rooms, adding that the organisation has also constructed twenty eight ICT centres in various Secondary Schools across Nigeria.
 
He said: “We are working to deploy Health Straightening system (HSS) at Hospitals at Iyi Enu (Anambra State), Ogijo (Ogun State) and Lapai community (Niger State. The HSS will help to improve service delivery, manpower, knowledge management, procurement, financial management and development of physical infrastructure”.
 
The managing director however stated that SNEPCO executed the various CSR project with -Esso, NAE & TEPNG its co-ventures, under the OML118 Production Sharing Contract (PSC) with the Nigerian National Petroleum Corporation (NNPC) as the license holder.
 
Reacting to the donation, Director, Social Welfare Department, Office of Youth and Social development in Lagos State, Musbau Abdulahi, commended the organisation and urged other corporate organisations to emulate the CSR gesture.
